1. Overview

These Terms of Service ("Terms") govern your use of the Startclaw platform and services ("Service") operated by Startclaw ("we", "us", or "our").

Startclaw provides a managed setup service for OpenClaw, an open-source AI assistant. By using our Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Startclaw sets up and configures an OpenClaw AI assistant on your behalf. Our Service includes the initial configuration, deployment, and onboarding of your assistant. We do not develop, maintain, or control the underlying OpenClaw software or any third-party large language model (LLM) providers.

3. Use at Your Own Risk

Your use of the OpenClaw assistant is entirely at your own risk. Startclaw acts solely as a setup and configuration service. We are not responsible for:

  • The outputs, responses, or behavior of the OpenClaw assistant
  • Any safety, security, or privacy risks arising from your use of the assistant
  • Data processed by, stored in, or transmitted through the assistant
  • Any harm, loss, or damages resulting from reliance on the assistant's outputs
  • Security vulnerabilities in the OpenClaw software or any third-party integrations

You acknowledge that AI systems can produce inaccurate, biased, or harmful outputs. You are solely responsible for reviewing and validating any information provided by the assistant before acting on it.

4. LLM API Costs Not Included

The Startclaw subscription does not include the cost of LLM API usage. Your OpenClaw assistant requires a connection to a third-party LLM provider (such as OpenAI, Anthropic, or others). You are responsible for:

  • Creating and maintaining your own API account with the LLM provider
  • Providing your own API keys during the setup process
  • Paying all API usage fees directly to the LLM provider according to their pricing
  • Monitoring and managing your API usage and associated costs

Startclaw has no control over and accepts no responsibility for third-party API pricing, availability, rate limits, or terms of service.

5. Refund Policy

All sales are final once your assistant has been set up. Because Startclaw delivers a one-time configuration service, we do not offer refunds after the assistant setup has been initiated or completed. By purchasing our Service, you acknowledge and agree to this no-refund policy.

If you experience issues with the initial setup process itself (e.g., the assistant was not deployed), please contact us at our contact page and we will work with you to resolve the issue.

6. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Attempt to circumvent any security measures or access controls
  • Resell, redistribute, or sublicense the Service without our written consent

8. Limitation of Liability

To the maximum extent permitted by law, Startclaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service or the OpenClaw assistant.

Our total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid to Startclaw in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service and the OpenClaw assistant are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections regarding liability, disclaimers, and indemnification survive termination.
